{"id":46,"date":"2009-01-20T20:05:00","date_gmt":"2009-01-20T20:05:00","guid":{"rendered":"https:\/\/karwin.com\/blog\/index.php\/2009\/01\/20\/is-this-legal\/"},"modified":"2009-01-20T20:05:00","modified_gmt":"2009-01-20T20:05:00","slug":"is-this-legal","status":"publish","type":"post","link":"https:\/\/karwin.com\/blog\/index.php\/2009\/01\/20\/is-this-legal\/","title":{"rendered":"Is This Legal?"},"content":{"rendered":"<p>A user recently asked a <a href=\"http:\/\/stackoverflow.com\/questions\/379510\/is-this-legal-gpl-software-licensing-issues\">question<\/a> about GPL compatibility with his company&#8217;s commercial software offerings:<\/p>\n<div>\n<blockquote><p>I work for a software \/ design firm and I recently found out that our &#8220;in house&#8221; CMS is actually [based on software] licensed under the <a href=\"http:\/\/www.gnu.org\/licenses\/gpl-2.0.html\" rel=\"nofollow\">GPL Ver 2.<\/a> I would like to know if it is ethical \/ legal to be selling this to clients. <\/p><\/blockquote>\n<\/div>\n<p>Don&#8217;t act on any legal advice you read on a forum like StackOverflow &#8212; including mine.  \ud83d\ude42  <\/p>\n<p>Here&#8217;s a <a href=\"http:\/\/en.wikipedia.org\/wiki\/GPL#Terms_and_conditions\" rel=\"nofollow\">passage<\/a> about GPL from Wikipedia (emphasis mine):<\/p>\n<blockquote>\n<p>The terms and conditions of the GPL   are available to anybody receiving a   copy of the work that has a GPL   applied to it (&#8220;the licensee&#8221;). Any   licensee who adheres to the terms and   conditions is given permission to   modify the work, as well as to copy   and redistribute the work or any   derivative version. The licensee is   <strong>allowed to charge a fee for this   service,<\/strong> or do this free of charge.   This latter point distinguishes the   GPL from software licenses that   prohibit commercial redistribution.   The FSF argues that free software   should not place restrictions on   commercial use, and the GPL explicitly   states that GPL works <strong>may be sold at   any price.<\/strong><\/p>\n<\/blockquote>\n<p>However, if your company is distributing the software under another license not compatible with GPL, then they&#8217;re violating their license.<\/p>\n<p><\/p>\n<p>I&#8217;m posting to my blog the questions I&#8217;ve answered on StackOverflow, which earned the &#8220;Good Answer&#8221; badge.
